Platform rules

1. Introduction

Rsale is an online marketplace for private and commercial classified ads in Serbia. We are not a party to the transaction between buyer and seller: users agree on terms, payment and delivery directly.

Even so, we set common rules so the platform stays safe, fair and useful for everyone. Breaking the rules can lead to ad removal, restricted features or account suspension.

2. Who the rules apply to

The rules apply to every Rsale user: individuals, sole traders and companies. Using the platform means you accept these rules, the Terms of Service and the Privacy Policy.

Legal framework: Serbian Trade Act, Consumer Protection Act, E-Commerce Act, Advertising Act, Personal Data Protection Act, Mortgage Act (real estate), Criminal Code.

3. Account

You need an account to post ads and message other users.

• One person or company — one main account. Duplicate accounts to bypass blocks or boost rankings are forbidden.
• Users must be 18+. Minors only with the consent of a legal representative.
• Provide accurate name, phone and email. Using someone else’s data, fake documents or third-party photos is forbidden.
• You are responsible for keeping your password safe. Do not share account access.
• Companies must provide PIB/MB and legal name when using business features.

4. Listing requirements

Every ad must be complete, accurate and easy to understand:

• One item — one ad. Do not bundle different items into one ad and do not duplicate identical ads.
• Title describes the item, not marketing promises. ALL CAPS, special characters, tags and emoji used to manipulate search are forbidden.
• Description states real specs, condition, defects and what is included. Do not put external links or contact details for competing platforms.
• Category and location must match the item. Post the ad in the city where the item physically is.
• Language — Serbian, Russian or English. Ads in other languages may be hidden until translated.
• Bait listings (fake low price to lure calls about a different item) are forbidden.

5. Photo requirements

• Use only your own photos of the actual item. Stock images, manufacturer catalogues and other sellers’ photos are forbidden, except for new items in factory packaging.
• Photos must match the item described in the ad.
• No watermarks, links or contacts for other platforms, no marketing overlays, no third-party logos.
• No nudity, offensive gestures or violence.
• At least one photo is required for most categories. Cars, real estate and electronics — at least three.

6. Price

• State a real price in RSD or EUR. Tricks like "1 dinar" or "on request" to game filters are violations.
• The price must include all mandatory fees. If you accept offers, mark the ad accordingly.
• Business accounts must show the price including VAT when the seller is VAT-registered, as required by the Consumer Protection Act.
• Hidden fees disclosed only in chat are forbidden.

7. Category specifics

Vehicles: include VIN (or its mask), mileage, year, paperwork status, customs status. Vehicles without serial identification or with forged VIN are forbidden.

Real estate: include area, rooms, floor, condition, ownership status (registered/unregistered), utilities. Phantom listings are forbidden.

Jobs: name a real employer, duties and conditions. "Work from home" with upfront payments, pyramid schemes and vacancies without a description are forbidden.

Services: describe what is provided, the price and the service area. Regulated services (medical, legal, etc.) are allowed only with proper licensing.

Animals: only ads from responsible breeders and rehoming are allowed. Commercial-scale breeding requires registration under veterinary law. Sale of wild and protected species is forbidden.

8. Prohibited goods and services

The following may not be listed on Rsale:

• Weapons, ammunition, explosives and their components (Serbian Weapons and Ammunition Act)
• Narcotics, psychoactive substances, precursors and any "legal" analogues
• Tobacco, vaping devices and liquids (distance sales restricted)
• Alcohol sold remotely to private buyers
• Prescription and over-the-counter medicines, supplements making medical claims, uncertified medical devices
• Counterfeits and brand replicas; goods with forged serial numbers
• Stolen property; goods without proof of origin where the law requires one
• Documents, IDs, diplomas, driver licences, certificates
• State decorations, military uniforms with current insignia, classified materials
• Biological materials, human organs and tissues
• Wild and protected species and products thereof (CITES)
• Sexual services, escort
• Surveillance gear, skimmers, tools for unauthorised access
• Cryptocurrency for cash via in-person meetings (regulatory and safety risks)
• Personal-data databases and any material breaching the Personal Data Protection Act
• Lottery tickets, gambling, sports betting access
• Items breaching sanctions regimes that Serbia takes part in

9. Prohibited conduct

• Fraud, phishing, attempts to deceive other users
• Inflated views, likes, reviews, ratings; paid reviews; fake reviews
• Repeated reposting of the same ad; spam in private messages
• Evading bans (new account after a block, VPN to bypass regional rules)
• Harvesting personal data outside Rsale, scraping the platform
• Redirecting users away from the platform to third-party sites to close the deal
• Discrimination based on nationality, religion, gender, age, disability, sexual orientation
• Threats, insults, harassment, doxxing
• Use of automated tools without Rsale’s written permission

10. Communicating with other users

Use the built-in chat — it is safer and helps in disputes.

• Be polite. Rudeness and obscene language are reportable.
• Do not share copies of passports, bank cards or access codes in open chat.
• Keep the conversation until the deal is closed.
• If someone pushes you to switch to WhatsApp/Viber for "a better deal with prepayment" — that is a classic fraud signal.

11. Transaction and payment

Rsale is not a payment intermediary and is not liable for the quality of goods or services posted by users. Still, we recommend safe formats:

• In-person meeting and inspection. The safest scenario for items and electronics — meet in a public place, inspect, then pay.
• Bank transfer. Transfers to the seller’s bank account are preferable to cash, especially for distance sales.
• Delivery with inspection. Use courier services that allow inspection on receipt. Never pay 100% upfront to a stranger without reputation.
• Contract and receipt. For cars, real estate and major electronics — sign a written contract; corporate sellers must issue a fiscal receipt under the Serbian Fiscalisation Act.
• Crypto, gift cards, foreign transfers to strangers — high-risk; not recommended.

12. Safety

• Meet in busy places during daylight.
• For a car test drive, check documents and insurance and keep your own copies of paperwork.
• For property viewings — go in pairs and never leave a deposit without a contract.
• Do not share SMS codes, CVV or one-time passwords — Rsale never asks for them.
• If an offer looks "too good" (a new iPhone for 10% of price, a car 50% below market) — it is almost always a scam.

13. Signs of fraud

Report a user via the "Report" button if they:

• Ask for prepayment via "parcel pickup link", "SNS delivery link" or "secure payment" on a domain that does not belong to Rsale
• Ask for card details, SMS codes or passwords
• Pressure you with urgency and threats of "losing the offer"
• Insist on closing the deal off-platform via Telegram/WhatsApp with a "bot" or "manager"
• Send a "bank payment" link — almost always phishing
• Use third-party photos (you can verify with reverse image search)
• Post many ads with suspiciously low prices

If you are defrauded, file a report with Serbian Police (MUP) and its High-Tech Crime unit. Keep the chat history, screenshots and bank details.

14. Verification and trust

• Verifying your phone and email increases trust.
• Business accounts with a verified PIB get a verified badge.
• Document verification is offered to sellers in higher-risk categories (cars, real estate, major electronics).
• Positive reviews and deal history are shown on the profile.
• Faking verification (verified badges in nicknames, "verified" watermarks on photos) is forbidden.

15. Moderation

Ads pass automated and human review:

• Pre-publication — automated checks against the rules and the prohibited-goods database.
• Post-publication — random and reactive (report-driven) review by moderators.
• Moderators may request extra evidence (e.g. proof of purchase).

Possible moderation actions: warning, hiding the ad until fixed, removing the ad, restricting features (posting, chat), temporary or permanent account suspension.

If you believe a moderation decision was wrong, write to info@rsale.rs with the ad ID — we review appeals within 8 working days.

16. Penalty scale

• Minor (wrong category, low-quality photos) — warning and a request to fix.
• Medium (duplicate ads, incomplete information, description issues) — ad hidden, posting temporarily restricted.
• Serious (prohibited goods, deception about condition, review fraud, spam, insults) — ads removed, account suspended for up to 30 days.
• Severe (fraud, sale of stolen goods, threats, criminal conduct) — permanent ban; data passed to law enforcement upon lawful request.

Repeat offences carry stricter penalties.

17. Disputes between users

Because Rsale is not a party to the deal, disputes are resolved primarily between buyer and seller. Steps:

• Contact the other party via Rsale chat and try to settle.
• If the seller is a business or sole trader, file a written complaint; they must reply within 8 days (Serbian Consumer Protection Act, art. 56).
• If unresolved: for consumer disputes — the Serbian Ministry of Trade or recognised consumer associations; otherwise — court.
• Rsale provides chat copies and ad data on lawful request from courts or the police.

18. Consumer rights

If the seller is a trader and the buyer is a consumer, the Serbian Consumer Protection Act applies:

• 14 days to withdraw from a distance contract without giving a reason (with statutory exceptions: personalised goods, perishables, opened hygiene goods, etc.).
• 2-year statutory conformity guarantee for new goods and at least 6 months for second-hand goods, unless agreed otherwise.
• Right to information: VAT-inclusive price, seller identification, payment and delivery terms.

Between two private individuals these rules do not directly apply — the general Law on Obligations governs.

19. Personal data

Personal-data processing is governed by the Serbian Personal Data Protection Act and our Privacy Policy.

• Do not collect more personal data from other users than the deal requires.
• Do not publish other people’s personal data (photos, phone, address) without consent.
• Use data you receive only for the deal and delete it once it is closed.

20. Rsale’s liability

Rsale provides the technical means to post ads and communicate. Under art. 16 of the Serbian E-Commerce Act, Rsale as a hosting provider is not liable for ad content until it gains knowledge of illegality.

We do not guarantee the quality, legality or accuracy of items and services posted by users. Liability for an ad and the resulting deal sits with the user who posted it.

Rsale takes reasonable steps to fight fraud but cannot prevent every case. Follow the safety practices above.

21. Changes to the rules

We may update these rules to reflect changes in law, new features and operational experience. Material changes are published on the site at least 7 days before they take effect. The last update date is shown at the top of the page. By continuing to use Rsale after changes take effect, you accept the updated rules.
