Terms of Service

1. General Provisions

These Terms of Service (hereinafter "Terms") govern the relationship between RSALE TECHNOLOGY AND DESIGN DOO BEOGRAD-NOVI BEOGRAD, Registration Number 154613764, Tax ID 21986437 (hereinafter "Rsale", "we", "Platform") and users of the platform rsale.rs (hereinafter "User", "you"). By using the platform, you accept these Terms in their entirety. These Terms are drawn up in accordance with the Law on Electronic Commerce (Official Gazette RS No. 41/2009, 95/2013, 52/2019) and the Consumer Protection Law (Official Gazette RS No. 88/2021).

2. Definitions

  • Platform — the website rsale.rs and all related services
  • User — any natural or legal person using the Platform
  • Seller — a User who publishes listings for the sale of goods or services
  • Buyer — a User who purchases goods or services through the Platform
  • Listing — a published offer of goods or services on the Platform
  • Account — a user account on the Platform

3. Registration and User Account

To use all Platform features, you must create a user account. By registering, you confirm that:

  • You are at least 18 years old or have parental/guardian consent
  • You provide accurate and complete information
  • You are responsible for maintaining the security of your account credentials
  • You will not create more than one account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Platform Services

Rsale is an intermediary platform that enables users to publish listings and conduct buying and selling of goods and services. Rsale is not a party to contracts between buyers and sellers and bears no responsibility for the quality, safety, or legality of listed goods or services, nor for the ability of sellers to fulfill their obligations.

5. Seller Obligations

The Seller is obligated to:

  • Publish accurate and complete information about goods or services
  • Act in accordance with the Consumer Protection Law and the Trade Law
  • Provide a clear price including all taxes and fees
  • Deliver goods or provide services in accordance with the listing
  • Respect the buyer's right to withdraw from the contract within the legal period
  • Issue a receipt or other document in accordance with the law

6. Buyer Obligations

The Buyer is obligated to:

  • Provide accurate delivery information
  • Pay the agreed price for goods or services
  • Accept ordered goods within the agreed timeframe
  • Report any defects within the legal period

7. Transactions and Payment

All prices on the Platform are expressed in Serbian dinars (RSD), including VAT where applicable. The Platform may charge a commission for certain services (listing promotion, featured positions, etc.). Commission terms are clearly displayed before the user uses the service.

8. Delivery

Delivery method and timeframes are agreed between the buyer and seller. Rsale does not perform delivery and is not responsible for any issues arising during delivery, except when logistics services provided through the Platform are used.

9. Right of Withdrawal and Returns

In accordance with Article 28 of the Consumer Protection Law, a buyer who is a consumer has the right to withdraw from a distance contract within 14 days of receiving goods, without stating reasons and without additional costs, except the cost of returning goods.

The right of withdrawal does not apply to:

  • Goods made to the buyer's individual specifications
  • Goods that spoil quickly or have a short shelf life
  • Sealed goods unsuitable for return after opening for hygiene or health reasons
  • Digital content delivered electronically with the buyer's consent

10. Prohibited Content

The following is prohibited on the Platform:

  • Goods or services whose sale is prohibited by law
  • Counterfeit or stolen goods
  • Weapons, explosives, drugs and narcotics
  • Pornographic content involving minors
  • Content promoting discrimination, hatred, or violence
  • False or misleading listings
  • Personal data of third parties without their consent

Rsale reserves the right to remove any content that violates these Terms without prior notice.

11. Intellectual Property

All elements of the Platform (design, logo, software, databases) are protected by intellectual property rights and belong to Rsale. Users retain rights to content they publish but grant Rsale a non-exclusive license to display that content on the Platform.

12. User Content and Listings

The User is solely responsible for content published on the Platform. By publishing content, you guarantee that:

  • You have the right to publish the content
  • The content does not infringe third-party rights
  • The content is accurate and not misleading
  • The content complies with the law

13. Limitation of Liability

Rsale, as an intermediary in electronic commerce, in accordance with the Law on Electronic Commerce, is not liable for:

  • Content published by users
  • Quality, safety, or legality of listed goods
  • Fulfillment of obligations between buyers and sellers
  • Data loss due to technical issues
  • Temporary unavailability of the Platform

Rsale is liable only for damage caused by gross negligence or intentional misconduct in providing its own services.

14. Data Protection

The collection and processing of your personal data is carried out in accordance with our Privacy Policy, which is an integral part of these Terms of Service.

15. Termination

The User may delete their account at any time. Rsale reserves the right to suspend or terminate the account of a user who violates these Terms without prior notice. In the event of account deletion, we retain transaction data in accordance with legal requirements.

16. Dispute Resolution

These Terms are governed by the laws of the Republic of Serbia. All disputes arising from the use of the Platform that cannot be resolved amicably shall be subject to the jurisdiction of the courts in Belgrade.

Consumers may submit a complaint to: info@rsale.rs. We will respond within 8 days of receipt in accordance with the Consumer Protection Law.
